If you plan to sell your home, the best way is by owner. Wait a minute, did I say that? A real estate agent telling a home owner the best way to sell your home is by owner sounds strange. It is what it is. If you can sell your home without paying a real estate agent, which means you are savings thousands in commission, it is a no brainer. Many home owners today have lost value over the last couple of years and many do not have the equity to sell the home and pay a commission.
The fact of the matter is that home owners today can do the same marketing that any real estate agent can do with the exception of putting the listing in the Multiple Listing Service. The Internet is where buyers are looking for homes. There are many sites in which homeowners can market their home at no cost.
With that being said, homeowners do need to understand there are many laws in regards to selling a home that you must be aware of. Different homes and or properties require different disclosures by the seller. These disclosures must be in writing and on the appropriate forms. The biggest problem I see with For Sale By Owners (FSBO) today is that they do not obtain and provide all the disclosures required by law. This will make the seller vulnerable to lawsuits and other liabilities.
It is critical to understand that the attorney closing the transaction does not see or ensure the disclosures have been made. The attorney is simply ensuring the seller has good and marketable title which means they can sell the home, and prepares the deed for transfer of ownership.
