Mediation FAQ's

Will I need an Attorney?

That is completely up to you.  You are more than welcome to consult with an attorney for legal issues and even have your attorney present for the mediation but you do not have to have an attorney present.  As the mediator, I just assist in helping the disputing parties find resolution that both are satisfied with.

How will the mediator be compensated?

Compensation consists of a $50 retainer fee to be paid by each party.  Additionally, each party will pay $50 per hour the mediator is needed.

Is Mediation legally binding?

Yes.  At the conclusion of the meeting, both parties will sign a settlement agreement which will express the terms in which both parties have agreed.  Should the parties not work out a resolution during the mediation process, the parties will be left with litigation to resolve the issues.

What is the role of a Mediator?

The mediator is a disinterested third party that will provide assistance in resolving disputes.  The mediator will offer suggestions and clarify the issues but does not offer legal services and will remain totally neutral throughout the negotiations.  All information provided and discussed will be kept confidential and the mediator cannot be called as a witness in court should the parties decide to litigate the matter.
